1. Introduction and Acceptance of Terms

Welcome to the FIRA AML platform website (the "Site"). By accessing or using our Site and its features – including submitting a Request a Demo form or using our live chat functionality – you agree to be bound by these Terms of Service (the "Terms"). These Terms form a legal agreement between you (the "User" or "you") and FIRA AML platform (referred to as "FIRA AML platform," "we," "us," or "our"). If you do not agree with any part of these Terms, please do not use the Site or its interactive features.

Scope: These Terms govern your use of the FIRA AML platform Site and any services or content provided through it. This includes informational content about our anti-money laundering (AML) compliance solutions, the demo request contact form, and any live chat or messaging services available on the Site. Additional terms may apply if you become a customer of our products or services, but those would be provided separately. By simply visiting our Site or engaging with the demo request or chat features, you acknowledge that you have read and understood these Terms.

2. Using Our Website and Services

We provide our Site and its features to help you learn about FIRA AML platform's compliance solutions and to facilitate communication with us. We grant you a limited, non-exclusive, non-transferable license to use the Site for legitimate, lawful purposes such as requesting product information or assistance. By using the Site, you agree to:

  • Provide accurate information: If you choose to fill out the demo request form or chat with us, you will provide true, accurate, and current information about yourself and your organization. Do not misrepresent your identity or your affiliation with a company.
  • Use the Site lawfully: You will only use the Site and its interactive features for lawful purposes. You must not use the Site to violate any laws or regulations, to infringe upon the rights of others, or to transmit any unlawful, harmful, or objectionable content.
  • Respect our systems: You agree not to interfere with or disrupt the operation of the Site. This includes refraining from introducing viruses or malicious code, attempting to hack or gain unauthorized access, or engaging in any activity that could overwhelm or impair the Site's infrastructure.
  • No spam or abuse: You will not use the demo form or chat to send unsolicited promotional content, spam, or repetitive messages. Harassing our team or using profane, obscene, or offensive language in communications is strictly prohibited. We reserve the right to terminate your access to the chat or ignore requests that are abusive, unlawful, or not made in good faith.

We reserve the right to suspend or terminate your access to the Site's interactive features (demo request form, chat, or the Site itself) at any time if we believe you have violated these Terms or are otherwise misusing our services. FIRA AML platform also reserves the right to decline to schedule a demo or respond to an inquiry if, for example, the request appears illegitimate or outside the scope of our services. Your compliance with the above usage rules helps us maintain a secure and productive environment for all users.

3. Demo Request Form & Live Chat

FIRA AML platform's Site offers a "Request a Demo" form and a live chat feature to facilitate communication with visitors interested in our AML compliance solutions. By using these features, you agree to the following:

  • Purpose of these features: The demo request form and live chat are provided to allow you to request more information about our products, schedule a demonstration, or ask questions about our services. They are not intended for emergency communications or for submitting confidential compliance data. These tools are for preliminary discussions and general inquiries related to our offerings.
  • Information you submit: When you fill out the demo request form, we will ask for information such as your first and last name, company/organization name, work email address, phone number (optional), industry, country, and a message describing your interest or question. In the live chat, you may be asked for your name, email, and any details of your question or issue. You agree that any information you provide is accurate and that you have the authority to share it (for example, you are using your own corporate email and representing your company truthfully).
  • Use of your inquiries: Once you submit a demo request or question via chat, our team will review your information and respond as soon as reasonably possible. For demo requests, a FIRA AML platform representative will typically reach out to you (by email or phone) to arrange a demonstration and discuss your needs. For chat inquiries, we will attempt to address your questions in real-time if an agent is available, or follow up via email if the chat is offline. Please note: While we aim to be responsive, immediate or 24/7 availability of a live representative is not guaranteed. Responses may be delayed due to time zones or outside of business hours.
  • No confidential or sensitive data: Please do not include highly sensitive or confidential information in your demo request or chat messages. The form and chat are meant for general business inquiries. For your security and ours, avoid sharing personal financial information, account numbers, passwords, or any sensitive compliance data about specific individuals or transactions through these channels.
  • Monitoring and records: By using the request demo form or chat, you consent that our communications may be monitored or recorded. We may keep a record of your request and our response (including chat transcripts and emails) to ensure quality service, to follow up on your inquiries, and for our internal training or documentation purposes. These records will be handled in line with our Privacy Policy (see Section 4 below).
  • No guarantee of demo or outcome: Submitting a request for a demo or engaging in a chat does not obligate FIRA AML platform to provide a demo or any specific service. While we will make a good-faith effort to accommodate demo requests, scheduling depends on availability and appropriateness of your request. Similarly, any guidance or answers provided in chat are based on the information you give and are intended to be helpful, but we do not guarantee that our response will fully resolve your questions or meet your expectations (see No Legal Advice in Section 6 and Disclaimers in Section 9).

By using the Request a Demo form or live chat, you agree to use these features only for their intended purpose and in accordance with these Terms. Misuse (such as using the chat to advertise to us, or sending inappropriate content) may result in termination of the chat and potential banning from our Site.

4. Personal Information and Privacy

Using our demo request form or chat requires you to submit certain personal information. FIRA AML platform is committed to protecting your data. Our practices regarding personal information are described in our Privacy Policy, which we encourage you to read. Below is a summary of how we collect and use your data in the context of the demo request and chat, and how we safeguard it:

  • Information we collect: As noted, the personal details we typically collect through the Site's interactive features include your name, contact information (email address and optionally phone number), your company and role, industry, country, and any message you choose to provide. In addition, our systems may automatically collect technical information like your IP address, browser type, and timestamps when you submit the form or use the chat. This technical data helps us secure our Site and understand usage patterns.
  • How we use this information: We use the information you provide strictly for business purposes, such as:
    • Responding to your inquiry or demo request.
    • Communicating with you to schedule and conduct a product demonstration.
    • Providing you with additional information about our services, features, or compliance resources that you have requested.
    • Following up on your interest in FIRA AML platform's solutions, which may include sending a one-time or periodic communication about product updates, events, or relevant news. (You will have the ability to opt-out of marketing emails at any time if you receive them.)
    • Improving our customer service – for example, information from chats may be reviewed to help train our team or to refine our responses to common questions.
  • Protection of your data: FIRA AML platform uses appropriate technical and organizational measures to protect the personal information you share with us. This includes employing encryption and secure protocols for form submissions, restricting access to personal data to authorized personnel, and using secure, reputable service providers to host our platform.   • Compliance with data protection laws: We understand the importance of data privacy and comply with applicable data protection regulations. If there is any inconsistency between these Terms and our Privacy Policy regarding personal data, generally the Privacy Policy will govern how we treat your personal information.

5. Third-Party Services and Tools

To enhance your experience and efficiently provide our demo scheduling and chat services, FIRA AML platform may rely on third-party service providers. By using the demo request or chat features, you acknowledge that third-party tools may be involved in processing your requests and you agree to their involvement. We want to be transparent about these relationships:

  • Chat platform: Our live chat support may be powered by a third-party platform (for example, Sales IQ, Intercom, Zendesk Chat, or a similar customer messaging service). When you use the chat, the information you input is processed through that provider's system and then delivered to our team. These providers may temporarily store data such as your chat messages, name, email, and any other information you provide during the chat session. FIRA AML platform chooses reputable chat service providers that have their own privacy and security measures; however, we do not directly control their systems. By initiating a chat, you agree to the processing of your data by the chat service provider on our behalf. We use such third-party services solely to assist us in communicating with you. We do not permit them to use your information for their own marketing purposes.
  • Demo scheduling tool: To streamline setting up meetings or demonstrations, we may use an external scheduling assistant, such as Calendly, Zoho Bookings or a similar scheduling service. If we provide you with a link or integration to schedule a demo, that scheduling process might occur through the third-party's website or widget. In that case, you might be asked to provide information (like your name, email, and chosen meeting time) directly to that service. Those details will then be shared with us to confirm the appointment. By using a scheduling link we send you, you may be subject to that third-party's terms of use and privacy policy. We will only use the information from the scheduling tool to arrange the meeting and will treat it in line with our own Privacy Policy once we receive it.
  • Other integrations: Our Site may also include links or integrate with other third-party services (for example, a video conferencing service for the demo, social media links, or analytic tools). Any third-party website linked from our Site is governed by that third party's own terms and policies, not ours. We are not responsible for third-party content or services that are not owned or controlled by FIRA AML platform. If you leave our Site to visit a link provided, you do so at your own discretion.

Important: While we carefully select third-party providers and aim to ensure they are compliant with relevant laws (including GDPR and other privacy regulations), FIRA AML platform cannot guarantee their performance or security. However, we contractually require service providers to protect your data and use it only for providing services to FIRA AML platform. By using our Site's demo request and chat features, you consent to our use of such third-party tools and acknowledge that your information may be transmitted through or stored by these services. If you have concerns about any third-party integration, please let us know and you may refrain from using the associated feature.

6. No Legal Advice or Professional Consultation

FIRA AML platform is not a law firm or a legal advisor, and nothing on our Site (including through the live chat or any communications during a demo) should be construed as legal advice. The materials, information, and responses we provide are for general informational purposes to help you understand our compliance software and services. While our team is knowledgeable about AML compliance practices, our guidance is focused on how our tools can assist you and does not constitute official compliance or legal advice about how to run your specific AML program.

  • No attorney-client relationship: Communicating with FIRA AML platform (via the website, email, chat, or demo) does not create an attorney-client or other professional advisory relationship between you and FIRA AML platform. We are a software provider and consultant for AML technology solutions, not your lawyers or compliance officers.
  • Informational content only: Any regulatory or compliance-related information on the Site or provided in our communications is meant to be general. Laws and regulations vary by jurisdiction and over time. The content on our Site may not always reflect the most current legal developments or requirements in your region. Do not rely solely on our information for making compliance decisions.
  • Consult your own advisors: You should seek advice from qualified legal or compliance professionals for any questions regarding laws, regulations, or obligations that apply to you or your organization. Any suggestions or statements made by FIRA AML platform in the course of a chat or demo are not a substitute for professional judgment specific to your situation.

FIRA AML platform will not be liable for any action or inaction you take based on information obtained from our website, chat, or demo. FIRA AML platform does not claim rights in third-party marks or content, but in many cases has permission to display them. You must not use any third-party content from our Site in a manner that infringes their rights.

8. User Responsibilities and Acceptable Use

In addition to Section 2 (Using Our Website and Services), we emphasize certain user responsibilities to ensure a safe and trustworthy environment:

  • Accuracy of information: You are responsible for the accuracy of all information you submit to FIRA AML platform. This includes information submitted through forms, chat, or any other means. You agree not to provide false, outdated, or misleading information. If your information changes (for example, you change jobs or your email address), please inform us or simply submit a new inquiry with updated details if relevant.
  • Authorization: If you are contacting us on behalf of a company or employer, you confirm that you are authorized to do so and to share the company details you provide. If you are not authorized, please do not use someone else's corporate details or impersonate any person or entity.
  • Responsible communications: You will communicate with our team and other users (if any interactive forums are provided in future) with professionalism and respect. Do not upload or send any content that is illegal, defamatory, harassing, invasive of privacy, or otherwise objectionable. We have zero tolerance for hate speech, discrimination, or any form of abuse.
  • No unauthorized access: You will not attempt to circumvent security measures, probe or test vulnerabilities of our Site, or access any service or area of the Site that you are not explicitly permitted to access. Any attempt to do so may result in immediate termination of your access and potential legal action.
  • Compliance with laws: You agree to comply with all applicable laws and regulations in connection with your use of the Site. Given the nature of our services, you should especially ensure that your use of our Site does not violate any AML, data protection, or financial regulations that apply to you. (For example, do not use our services to facilitate any activity that would contravene sanctions or anti-money laundering laws.)
  • Indemnification: If you violate these Terms or misuse our Site, and that causes harm to FIRA AML platform or any third party, you agree to indemnify and hold FIRA AML platform harmless from any resulting liability, losses, or expenses. In plain terms, this means you may have to reimburse us for costs or claims arising from your breach of these Terms. We would much prefer that everyone simply follow the rules to avoid any such issues.

By fulfilling these responsibilities, you help us maintain the integrity of our Site and services. FIRA AML platform reserves the right to take appropriate action (including termination of access, and involvement of law enforcement if necessary) against any user who violates these responsibilities or any other provision of these Terms.

9. Disclaimers of Warranties

Use of Site at Your Own Risk: FIRA AML platform provides this Site and its features on an "as is" and "as available" basis. While we strive to keep content up-to-date and services operational, we make no warranties or representations of any kind regarding the Site. To the fullest extent permitted by law, FIRA AML platform disclaims all warranties, whether express, implied, or statutory, including but not limited to:

  • Accuracy and Completeness: We do not guarantee that the information on our Site (including brochures, blog posts, or responses in chat) is accurate, complete, or current. Regulatory requirements change frequently, and while we try to provide helpful information, there may be errors or omissions. Use any information from our Site at your own discretion.
  • Availability: We do not warrant that the Site, the demo request form, or the chat service will be available at all times, or that your use will be uninterrupted or error-free. Technical issues or maintenance needs may occasionally make the Site or certain features temporarily unavailable. We appreciate your understanding in such cases.
  • Quality and Fitness: FIRA AML platform disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For example, we do not warrant that visiting our Site or requesting a demo will guarantee any particular compliance outcome or benefit for you. The Site is provided for general information and to facilitate initial engagement with us; the ultimate suitability of our products or information for your needs is something you will need to evaluate.
  • Security: We employ security measures (as noted in Section 4), but we cannot guarantee that the Site will be free from security breaches, viruses, or other harmful components. 10. Limitation of Liability

To the extent permitted by law, FIRA AML platform's liability to you is limited. This includes, but is not limited to:

  • Loss of data or business: We are not liable for any loss of your data, lost profits, business interruption, or loss of business opportunity that may result from using our Site or relying on its content. For example, if you experience delay in getting a demo or a response, and that causes you some business inconvenience or cost, FIRA AML platform will not be responsible for those outcomes.
  • Errors or omissions: FIRA AML platform will not be liable for any consequences arising from errors, mistakes, or inaccuracies of content on the Site, or from any actions you take in reliance on information gained through the Site or chat. It is your responsibility to verify information and/or seek professional advice as needed (as stated in Section 6).
  • Unauthorized access or security incidents: We are not responsible for damages resulting from unauthorized access to our systems or to your personal data, unless required by applicable law. We take precautions, but if a malicious actor defeats our security measures, FIRA AML platform shall not be held liable for resulting harm that we could not reasonably prevent.
  • Third-party acts: FIRA AML platform is not liable for the conduct or content of third parties that we do not control, including other websites or services that might be linked or integrated (see Section 5). If, for instance, a third-party scheduling service has an outage or a security issue, we will work to mitigate any impact on you, but we cannot be responsible for the direct effects of that third-party's issue.
  • Cap on liability: In jurisdictions where a limitation of liability is enforceable, if FIRA AML platform is found liable to you for any claim or cause arising from your use of the Site or our services, our total cumulative liability shall be limited to the amount (if any) you paid us for services through the Site, or AUD $100 (one hundred Australian dollars) – or an equivalent amount in your local currency – whichever is less. This cap applies collectively to all claims, whether arising from contract, warranty, tort (including negligence), strict liability, or otherwise.

Exceptions: Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law. For example, FIRA AML platform does not exclude liability for gross negligence, willful misconduct, or personal injury caused by our proven fault, to the extent such liability is mandated by law. Additionally, your statutory rights (such as certain consumer rights) are not affected. However, because our Site and demo/chat services are provided free of charge to prospective customers, you acknowledge that this limitation of liability is a fair allocation of risk.

11. Changes to These Terms

FIRA AML platform may update or modify these Terms of Service from time to time. As our business and regulatory environment evolves, we might need to clarify our Terms or address new features. When we make changes, we will update the "Last Updated" date at the bottom of this page. For significant changes, we may also provide a notice on our Site or notify users via email if appropriate.

It is your responsibility to review these Terms periodically for updates. Continued use of the Site or its services after any modifications to the Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should discontinue use of the Site and its interactive features.

12. Governing Law and Jurisdiction

These Terms of Service and any dispute arising out of or relating to the Site or these Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. (If you are unsure of this jurisdiction, please contact us for more information. Typically, it will be the local law of FIRA AML platform's main office or incorporation.)

By using the Site, you agree that any disputes or claims shall be subject to the exclusive jurisdiction of the competent courts in Australia, except to the extent that applicable law in your country of residence requires otherwise. We acknowledge that if you are accessing our Site from a different country, you may have certain protections under local consumer laws; nothing in this section is intended to override any such mandatory protections, except that you are agreeing to submit to the jurisdiction of the specified courts where legally permissible.

International Use: FIRA AML platform's Site can be accessed worldwide. If you access the Site from outside of our primary jurisdiction, you do so on your own initiative and are responsible for compliance with local laws. These Terms are enforceable to the fullest extent permitted in each applicable jurisdiction. We make no representation that the content or features of the Site are appropriate or available for use in every location.
